Missed a council tax payment? What happens next
Miss a council tax instalment and a reminder gives you 7 days — then the whole year falls due. What happens next and how to stop it.
Council tax doesn’t behave like other household bills. Miss a phone payment and you get nudges for months. Miss a council tax instalment and you’re on a short, legally defined ladder where the third step is the whole year at once.
The escalation ladder
- 1Missed instalment → reminderThe council sends a reminder. You have 7 days to bring payments up to date. Pay: everything continues monthly as before.
- 2Reminder ignored → full year dueAfter the 7 days, you lose the right to instalments and the council can demand the entire remaining year’s balance.
- 3Final notice → court summonsA summons adds costs. The council applies to magistrates for a liability order — the hearing is largely procedural if the tax is owed.
- 4Liability order → enforcementEnforcement agents (with their own fees), deductions from wages/benefits, and in rare persistent cases further court action.
If money is the problem, not memory
The ladder above assumes silence. Talking changes it:
- Rescheduling — most councils will spread arrears, and you can ask to pay over 12 months instead of the default 10, cutting each instalment.
- Council Tax Reduction — if income has fallen (job loss, parental leave), you may be entitled to pay less going forward. Apply through your council.
- Check the band while you’re at it — our guide on checking your council tax band covers the one-in-twenty chance you’ve been overpaying all along.
In short
One missed instalment is a 7-day problem; ignored, it becomes a whole-year debt with court costs attached. Pay the reminder or phone the council inside the window — and give the due date a home where both of you can see it.
Frequently asked questions
How many reminders do I get?
Usually two in a tax year. A third missed instalment typically triggers a final notice demanding the full remaining balance for the year — with no further reminders.
What is a liability order?
A court order confirming you owe the debt, which unlocks the council’s stronger powers: enforcement agents (bailiffs), deductions from wages or benefits, and in some cases charging orders. It also adds court costs to what you owe.
What if I genuinely can’t pay?
Contact the council before the 7 days run out — most will reschedule instalments (including spreading over 12 months instead of 10), and you may qualify for Council Tax Reduction if your income has dropped. Councils have discretionary hardship powers too; ask.
Does a missed payment affect my credit score?
Council tax arrears aren’t reported to credit reference agencies in the way loans are — but a liability order is public and the enforcement route is far more disruptive than a credit mark.
